By this Privacy Policy (hereinafter – Privacy Policy), the private limited liability company “ZBIGA”, company code 123645712, registered address Beržų str. 2B, Riešė, Vilnius dist., (hereinafter – the Data Controller) establishes the terms and conditions for the processing of personal data using the website operated by the Data Controller www.magresbaldai.lt (hereinafter – the Website). The terms and conditions set out in the Privacy Policy apply every time you visit the website, regardless of the device you use (computer, mobile phone, tablet, TV, etc.).

By providing his/her personal data (including the data provided directly or indirectly by visiting the website and using its services), the Data Subject shall agree and shall not object to their management and processing by the Data Controller for the purposes and procedures specified in this Privacy Policy, as specified in the Data Subject’s consent and in accordance with the legal acts.

Participant means a person participating or intending to participate in games, campaigns and/or tenders organised by the Data Controller.

The Applying Person, Customer, Candidate, Caller by phone or any other natural person whose personal data is processed by the Data Controller shall be regarded as the Data Subject in this Privacy Policy.

Applying Person means a natural person interested in the services provided by the Data Controller or wishing to contact the Data Controller on other issues.

Customer means a person who has purchased goods and/or services from the Data Controller or has entered into a contract with the Data Controller regarding the provision of goods or services.

Candidate means a person who participates or intends to participate in the selection of personnel performed by the Data Controller.

Caller by phone means a person calling via the contact phones specified on the Website regarding the sale of goods or provision of services of the Data Controller and/or other issues.

The Data Controller will collect personal data in accordance with the requirements of the applicable legal acts of the European Union and the Republic of Lithuania as well as the instructions of the controlling institutions. All reasonable technical and administrative measures shall be taken to protect the collected data on Data Subjects from loss, unauthorised use and alteration thereof.

Persons under the age of 16 may not provide any personal data via the Website of the Data Controller. If you are a person under the age of 16, you must obtain the consent of your parents or other legal guardians before submitting your personal information.

This Privacy Policy has been compiled in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter - the General Data Protection Regulation), the Law on the Legal Protection of Personal Data of the Republic of Lithuania, other legal acts of the European Union and the Republic of Lithuania. Processing of personal data by Applying Persons, including Callers by telephone, to the Data Controller for the purpose of consulting, querying or/and other matters. The Data Controller shall process the following personal data of Applying persons, including Callers by telephone:

Place of residence.

In the event that the Data Controller is contacted by the representative of the Applying Person, the Data Controller shall process the following data of the applying representative:

Name;

Surname;

Relationship with the applying Data Subject;

The data of Applying Persons shall not be transferred to third parties.

 

PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF THE SALE OF GOODS OR THE PROVISION OF SERVICES

The Data Controller shall process the following Customer Data:

Name;

Surname;

Legal entity code (if applicable);

VAT number (if available);

Telephone number;

E-mail address;

Address;

Other information related to the goods and/or service being purchased.

In the event that the Customer is represented by another natural person or legal entity, the Data Controller shall process the following personal data of the Customer’s representative:

Surname;

Relationship with the applying Data Subject;

Telephone number;

E-mail address.

The data are obtained directly from the Customers or their representatives, possessing their consent, whether in performance of the contract with the Customer or/and from other third parties having relations with the Data Subject, as appropriate, shall be transferred to the following recipients:

The Data Controller shall undertake not to transfer your personal data to any unrelated third parties, except in the following cases:

· If there is your consent to the disclosure of personal data;

· When providing services to our partners in order to implement the services ordered by you. We will provide these service providers with only as much personal information as will be necessary for the performance of the specific service;

· In the implementation of the legitimate interests of the Data Controller (e.g. in the case of debt collection);

· To authorised institutions, in accordance with the procedure laid down by legal acts of the Republic of Lithuania.

The Data Controller may provide the personal data of Customers and other Data Subjects to Data Processors not referred to in this Privacy Policy, who provide services (perform works) to the Data Controller and process personal data of Customers and Data Subjects on behalf of the Data Controller. Data Processors shall have the right to process personal data only in accordance with the instructions of the Data Controller and only to the extent necessary for the proper performance of the obligations laid down in the contract. By employing the Data Processors, the Data Controller shall take all necessary measures to ensure that the Data Processors have implemented appropriate organisational and technical security measures and maintain the secret of personal data.

The processing of personal data for the purposes of the sale of goods and the provision of services shall be based on the following: consent of the Data Subject and/or performance of the contract with the Data Subject (Article 6(1)(a) and (b) of the General Data Protection Regulation).

 

PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF ORGANISING GAMES, CAMPAIGNS, TENDERS

The Data Controller may process personal data for the purposes of tenders or campaigns only with the consent of the Data Subject. The Data Controller may collect the following personal data of the Participants:

Photographs;

Telephone;

E-mail;

Address of residence.

The Data is obtained directly from Data Subjects participating in games, campaigns and/or tenders. These data are not transferred to third parties, but may be made publicly available on the Website of Data Subject and/or on Facebook and/or Instagram accounts owned by the Data Controller. The Data Controller may publish the following: name, surname or pseudonym, photo presented on the social network.

Personal data are processed on the basis of the consent expressed in the submission of your personal data (Article 6(1)(a) of the General Data Protection Regulation).

 

PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF DIRECT MARKETING

The Data Controller seeks to share with the recipients of newsletters only relevant news about the goods sold by the Data Controller, events organised (by the Data Controller himself or together with other persons), discounts, offers, tenders and other useful information. This is implemented in accordance with this Privacy Policy.

The Data Controller shall process personal data for the purpose of direct marketing only with the explicit consent of the Data Subject. The following personal data of Customers and other Data Subjects shall be processed for the purpose of direct marketing:

E-mail address.

After sending the newsletter, the Data Controller shall collect statistical data about the behaviour of the Data Subject in relation to the use and content of the newsletter (for example, whether the newsletter was read, what links were opened by the Data Subject).

The e-mail address of the Data Subject may be used to provide advertisements via Facebook, Google and other advertising platforms, adapting advertisement to the target audience.

According to your personal data, for the purpose of direct marketing, profiling of your personal data may be carried out in order to propose you customised solutions and offers. You may, at any time, withdraw your consent to the processing of personal data by automated means, including profiling, or object to it (if such a method is applied).

The Data Controller may transfer personal data received directly from Data Subjects only to third parties providing marketing services.

Personal data of Customers and other Data Subjects shall be processed on the basis of consent expressed in the submission of their data and consent to the processing of personal data for the purpose of direct marketing (Article 6(1d)(a) of the General Data Protection Regulation).

We hereby inform you that the Data Subject shall have the right to object or withdraw his/her consent to the processing of his/her personal data for direct marketing purposes at any time, including profiling, insofar as it relates to such direct marketing, without giving reasons for the objection:

The withdrawal of consent shall not affect the lawfulness of the consent-based data processing carried out prior to the withdrawal of consent.

 

PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF ENSURING THE SECURITY OF PERSONNEL, CUSTOMERS AND PROTECTION OF PROPERTY (VIDEO SURVEILLANCE)

The Data Controller shall process the video data of its personnel and Customers as well as other persons entering the video surveillance field for the purposes of ensuring the protection of their property (video surveillance) in order to ensure their security and the property.

Please be informed that your video data is captured by the Data Controller’s video surveillance equipment when you visit the shops of the Data Controller. Video data may only be transferred to law enforcement authorities in accordance with the procedure provided for in the legal acts of the Republic of Lithuania.

Personal data for video surveillance purposes shall be processed on the basis of the legitimate interest of the Data Controller (Article 6(1)(f) of the General Data Protection Regulation).

 

WHAT DO WE DO TO PROTECT YOUR INFORMATION?

Personal data shall be protected against loss, unauthorised use and alteration thereof. We have implemented physical and technical measures to protect all information we collect for the purpose of providing our services. The Data Controller applies different time limits for the storage of Personal Data in accordance with the requirements of legal acts and taking into account the purposes of the processing of personal data.

Processing of personal data of Data Subjects for consultation purposes, for the execution of queries, shall be as follows:

One year from the date of the consultation, the completion of the query. Unless the Data Subject applies for the purchase of goods of the Data Controller or the provision of services. The general deadline of ten years shall then apply.

Personal data of Customers - for the purpose of selling goods:

ten years since the last contact.

Processing of personal data of Data Subjects for the purpose of organising games, campaigns, tenders:

One year from the date of completion of the tender.

Processing of personal data of Data Subjects for the purpose of direct marketing:

Five years from the date of receipt of the consent, except for the cases where the Data Subject wishes to extend this period.

Exceptions to storage periods may be established to the extent that they do not violate the rights of the Data Subjects, comply with legal requirements and are properly documented.

After expiry of the time limits set, if they have not been extended, the data will be erased in such a way that they cannot be restored.

 

YOUR RIGHTS

The Data Subject whose data are processed in the activities of the Data Controller shall have the following rights:

• Know (be informed) about the processing of his/her data (the right to know);

• Access to his/her data and how they are processed (the right to access);

• Require the rectification or, depending on the purposes of the processing of personal data, the completion of incomplete personal data (the right to rectify);

• Destroy or suspend his/her data (except storage) (the right to destroy and the right ‘to be forgotten’);

• Shall have the right to request that the personal Data Controller restrict the processing of personal data in the presence of one of the legitimate reasons (the right to restrict);

• Shall have the right to transfer of data (the right to transfer);

• Object to the processing of personal data when such data are processed or intended to be processed for direct marketing purposes, including profiling insofar as it relates to such direct marketing;

• Submit a complaint to the State Data Protection Inspectorate of the Republic of Lithuania.

The Data Subject shall have the right to submit any request or instruction related to the processing of personal data to the Data Controller in writing in one of the following ways: by serving directly to the address Beržų str. 7, Riešės village, Vilnius district; by post: Beržų str. 7, Riešės village LT-14266, Vilnius district; by e-mail: info@magre.lt.

Upon receipt of such a request or instruction, the Data Controller shall, at least thirty calendar days from the date of referral, submit a reply and perform or refuse to perform the actions specified in the request. Where necessary, the specified period may be extended by sixty calendar days, taking into account the complexity and number of requests. In such a case, the Data Controller shall, within thirty calendar days of the date of receipt of the request, inform the Data Subject of such extension along with the reasons for the delay.

The Data Controller may not create conditions for Data Subjects to implement the above-listed rights, except for objecting to the processing of personal data by direct marketing, when in the cases provided for by the laws, it is necessary to ensure the prevention, investigation and detection of criminal offences, breaches of official or professional ethics, as well as the protection of the rights and freedoms of the Data Subject, the Data Controller or other persons.
